Philip Mann was arrested for the offence of possession of marijuana for the purpose of trafficking under Section 5(2) of the Controlled Drugs and substances Act. After the arrest, Mann appealed his case. The reason of the appeal was that the search on him was unlawful. His argument was that the police who have detained and searched him had no legal rights to search his body. According to the Charter of Rights and Freedom Section 9, everyone has the right not to be arbitrarily detained or imprisoned. In the case of Philip Mann, however, the detention was justified. A police officer may arrest or detain without warrant when they have reasonable grounds to believe that a person has committed an indictable offence According to section 495 of the Criminal Code. Prior to the detention of Mann, the police officers were provided with the description of the suspect for the break and entering and since Philip Mann matched the description of the suspect, police officers had a reasonable ground to stop and conduct an investigative detention. Everything was very clear and lawful until this point. Mann was compliant towards the officers and allowed a pat down search. Unlike the search procedure incident to arrest where police officers are authorized to search a person f or weapons, evidence and means of escape, a pat down search is only used as a protective measure; to remove any weapons that may harm the officers. Police officers are only authorized to roughly check if the detainee has a weapon, they cannot go through their pockets or belongings. Unless the officer who reached into Mannà ¢Ã¢â ¬Ã¢â ¢s pocket had a reasonable ground that what he felt in Mannà ¢Ã¢â ¬Ã¢â ¢s pocket during the pat down was a weapon, he must not search his pocket. For example, a police officer detains a suspect that matches the description for an armed robbery suspect. The officer may perform a pat down check on the suspect to ensure the safety of themselves as well as people around them. However, unless the officer can identify that some object that the suspect has underneath their clothing is a weapon, they may ask what it is but not reach into the suspectà ¢Ã¢â ¬Ã¢â ¢s clothing and grab it out as the search is not the result of an arrest. During t he appeal of this case, the Court found that the detention was on reasonable grounds. The two officers had reasonable grounds via suspect description that matched Mann. When the officer reached into Mannà ¢Ã¢â ¬Ã¢â ¢s pocket, at that moment the focus of the search changed from a security search to evidence search in which the officers lacked reasonable ground on. This completely violated section 8 of the Canadian Charter of Rights and freedoms. The Court added that even if the officer acted in good faith, it cannot be claimed if there is a violation of the Charter. As mentioned above, if the right of an individual is infringed in any way during an arrest or a detainment (section 24 Charter of rights), any evidence that are found must be neglected on trial. In other words, the 27 grams of mari juana and other pills found cannot be used against Mann, rendering the charge of possession for the purpose of trafficking useless. In my opinion, the police officers who has responded to the dispatch of a break and enter should have responded differently. It is very true that Mann matched the initial description of the suspect of the dispatch; however, the dispatcher gave the name and age of the real suspect in the first place. Upon establishing identity with Mann, the police officers should have realized that Mann was not the person they were looking for. The officers should have warned Mann of the incident and allowed him to leave. Upon reading about this case law, I asked myself what would I have done if I was the arresting officer to avoid the arguments this case brought up? Well, I am very strict when it comes to rules especially when it comes to our civil rights. As an officer, I would first establish the identity of the suspect. When the identity is established, I woul d ask the following questions to myself. What is my authority on detaining this person? à ¢Ã¢â ¬Ã¢â¬Å" I have reasonable grounds to believe this is the suspect of a Break and enter as he matches the description of the suspect although name is not the same. Alfred Adler studied personality around the time of Sigmund Freud and Carl Jung but developed very different ideas (Cloninger, 1996). Although he changed his theory many times during his lifetime, he always believed people had control over their lives and made choices concerning themselves. He named his theory Individual Psychology because he felt each person was unique and no previous theory applied to all people. Adler's theory is comprised primarily of four aspects: striving towards superiority, the unity of personality, the development of personality, and psychological health, which includes intervention. Motivation of Actions Adler believed the main goal of all people is to move to a better way of life, although he admits the ways to achieve this goal varies among people (Cloninger, 1996). He first used the term inferiority complex as being overcome by feelings of lack of worth. In other words, the person is not achieving their goal to moving positively in life. People wish to move from feelings of inferiority to superiority. He wrote, We all wish to overcome difficulties. We all strive to reach a goal by the attainment of which we shall feel strong, superior, and complete (Ansbacher & Ansbacher, 1956). Superior and superiority, in his usage, has a slightly different meaning than what is commonly thought. It is not necessarily feelings of superiority over others but more along the lines of self-improvement, such as striving for one's personal best. He eventually switched from superiority striving to simply perfection striving. This was the final stage in the development of his theory. Alder also used the word superiority complex. This complex occurred when a person tried to overcome their inferiority complex by repressing their actual feelings. They are usually very arrogant and tend to exaggerate their achievements. Along with the idea of trying to overcome inferiority, Adler claimed that every person had an idea about what their perfect self would be like (Cloninger, 1996). He called this imagined goal the fictional finalism. Fictional finalism gives clearer direction as to what decisions to make concerning oneself. Although people may have some idea about their goal, they rarely fully comprehend it. Also, throughout one's lifetime the goal may be altered. The word wanted there is incidents, not incidences. Incidence is one of those words, like disinterested and percentile, that tends to crop up where it doesnt belong. Both incident and incidence derive from a medieval Latin word with the sense of to fall into, to fall upon, or happen to. Look up both words in the OED and you will find numerous meanings. All that need concern us here is the most common use of each word in modern English. The title of the movie, by the way, is The Ox-Bow Incident. As a noun incident means an occurrence or an event. It can be something trivial. That reminds me of an incident that occurred while I was walking the dog. Foreign travelers are warned against behavior that might provoke an incident. Here the meaning is an event that could lead to political difficulties between two governments. Incidence has a mathematical meaning. In geometry it means The situation of one locus with respect to another when they have a common point or points, but do not completely coincide; e.g. of a point to a line on which it lies, of a point or a line to a plane in which it lies, or of two intersecting lines to each other. Its a term used by airplane pilots: The pilot is able to increase or decrease the lift by altering the angle of incidence. Ibid., As the angle of incidence increases, the lift also increases and the aircraft is able to climb, but if the tilt is made too large the flow on the upper surface separates and eddies are formed. The most usual non-specialized meaning is Manner of falling upon or affecting in any way; the range or scope of a thing, the extent of its influence or effects. We can speak of the incidence of poverty in depressed areas of the country, or the incidence of disease in a given population. Gone are the days that the existence of nursing geared towards following the orders of senior members on the profession and initiation of routine procedures. In todayââ¬â¢s nursing, nurses are valued and needed for their reasoning as well as intellectual skills. The changes in nursing require the desire to be more responsible and contributory to the wellbeing of those that needed care. These changes led to more complex ethical dilemmas that nursesââ¬â¢ encounter. This paper aims to provide a reflection on the Ethical Dilemmas presented on the Ethics Game Simulation, the decision-making steps taken to address the ethical issues, how the ethical concepts influenced the decisions made, and the application of the ethical concepts to a medical-surgical unit. The Case of the Troubled Teen This case illustrates Rachel Banks a 16 year-old teenager who got pregnant out of wedlock and currently on her tenth hour of labor on the OB/GYN unit at Seva Medical Center. Sheââ¬â¢s accompanied by her parents. Rachelââ¬â¢s parents are instructing the staff nurses to withhold the pain medication as punishment for getting pregnant before getting married. Since Rachel Banks is a minor, legally, the parents can decide for her. The nurses are concerned due to the possible detrimental health effects that the situation can cause to Rachel and her unborn baby, Lily. The nurses also became aware that the parents may not be fully educated on the consequences of their decision. In order to make an ethical decision on this case, I used the Baird Decision Model which provided five frameworks: Step 1: Be attentive, Step 2: Be Intelligent, Step 3: Be Reasonable, Step 4: Be Responsible, and Step 5: Be Reflective (University of Phoenix, 2013). The main issue in this case is how to ensure that Rachel and the baby get appropriate and timely medical care. I reviewed the e-mails and communications gathered in order to get a picture of the situation and see that the best possible solution arise. Upon understanding the main issue of this case, Iââ¬â¢ve identified that the primary stakeholders includes; Rachel Banks, her parents, her unborn child, the staff nurse, and the primary nurse because they will be impacted on the decisions made in this situation. After identifying the main issue and the primary stakeholders, using the rights/responsibilities lens I was able to identify that my obligations and duties includes providing the best possible care to Rachel Banks and her unborn child, not to accommodate parents who are harming their child, and also support my staffââ¬â¢s professional improvement. On the results lens, I was able to recognize what would create the greatest good for the greatest number of stakeholders which was to involve the nurses and the parents in assessing need for medication intervention and also provide information for aftercare support and education. I believe that the decision made on this scenario benefits both the patient and her family. By involving the parents in the assessment of Rachelââ¬â¢s medical needs, conflict is alleviated and thus, creates a positive outcome. The Case of the Policies and Politics This case is about Alain Trottier, a patient brought in the emergency room by his domestic partner, Yves. Alain was admitted to the ICU unit and has been unconscious. The day- shift supervisor, Carlotta Baldwin is preventing Yves from seeing the patient and refuses provide information regarding the patient because he is not an actual family member. However, according to the hospital policy, domestic partners are to be treated as married couples for the purposes of access and, most importantly, when it must be determined who can make medical decisions for a patient unable to give their own consent. My duty as the nurse taking care of Alain is to identify the critical issue in this situation which is the equal treatment and access of gay partners at Seva Medical Center as equal to those of straight couples. Upon identifying this as the main issue, it is easier to analyze the problem. Again, the following stakeholders were identified: Alain Trottier (patient), Yves (domestic partner), C arlotta Baldwin, RN (shift supervisor), Amelia Flinch (Director of Nursing), the shareholders of the hospital, and lastly, I the staff nurse taking care of Alain. This scenario has led to the identification of relationship lens. The relationship lens focuses on the community. The main concern of this lens is to provide basic liberties to all people (University of Phoenix, 2013). The three rights represented in this case were: right to participate in decision-making for an unconscious family member, right to have hospital policy regarding participation by family members implemented, and right to be informed that your interpretation of hospital policy is inaccurate. I believe that these rights are the major component of this lens because it focuses on the patient, family, and healthcare providers. Upon understanding the basic rights related to this situation, the following actions such as educating all employees with hospital policies, establishing a taskforce to make sure that the policies are put into practice and conducting yearly audits to make sure that the policies are implemented. These actions will ensure that the patient will benefit greatly on the policies placed on the facility. Lastly, the reputation lens discusses the virtues important for leadership; core competencies such as managing diversity, problem-solving, self-knowledge, decision quality and fairness. These values are important because of the overall positive effect that it can bring to the patient and the facility. My final decision in this case is to note on Alains chart that Yves is to be given access and treated as family. Speak to Carlotta about my decision and let my supervisor know. I believe that this decision has no risk. This decision has demonstrated that I am fully knowledgeable on the hospital policies and also implementing what I know for the benefit of my patient. By assuring equal access will likely improve the hospitalââ¬â¢s status in the community. Lastly, by informing Carlotta Baldwin and the supervisor know of the decision can be a message that further education is needed for all employees to be more aware and knowledgeable of the hospital policies. Ethical Dilemma at a Medical-Surgical Unit Iââ¬â¢ve been working as a RN at a medical-surgical unit for almost a year now. I still consider myself as a novice nurse and I feel that I havenââ¬â¢t been exposed to a lot of ethical dilemmas. However, I believe that pain management or providing pain relief can be an ethical dilemma for any nurse. The ethical issue is this: can we as nurses undertreat a patientââ¬â¢s pain because we are concerned about the repercussions or because we know that the patient is addicted to the medication. I believe when challenging situations like this arise, I need to be conscious of my own biases and make evidence-based decisions that can provide optimal treatment to the patient. By not being judgmental, I can fully assess what would benefit my patient greatly and include him/her on the treatment plan- giving autonomy. By including the patient I can also decrease the harm because I will have a better understanding of what will work best for my patient, and lastly, by hindering my biases I will be able to treat my patientââ¬â¢s pain in a non-discriminating way possible. As nurses continues to encounter complex ethical dilemmas as the profession and society gears forward, we must still go back on the foundation of nursing in accordance to the mission of Florence Nightingale; nurses are missioners of health dedicated to the advancement of human welfare. Family is very important to the Algorââ¬Ës as it can be found in the constant crying and discussions by the family.
