Also, I would look at the intent to commit a crime, and request psychiatric evaluations of the offender. Some juveniles may have mental problems that make them commit certain crimes. A mental evaluation may enable the court to determine whether the offender knows how to differentiate right from wrong. Office of the United States Attorneys (n.d) indicates that Juvenile Justice and Delinquency Prevention Act of 1938 gave the Attorney General the right to prosecute juvenile offenders with the exceptions of offenses punishable by death or imprisonment. As a prosecutor, I would suggest probation or community service for a juvenile offender who has committed minor crimes. The reason is that children can receive redemption and reform quickly. More so, some juveniles lack a sense of maturity and responsibility. Probation and community service might make the offender avoid future crimes. Furthermore, factors that I would consider regarding waiving the case to an adult court would be the nature of the alleged crime, age, rehabilitative prospects, maturity, and history of crimes. A juvenile who is 16, 17 or 18 and has committed crimes such as murder or robbery with violence may be transferred to adult court depending on the severity and recurrences of their crimes. US Department of Justice (2011) notes that in presumptive waiver cases, a juvenile who meets age, transgression, or other legislative inceptions must present waivers disproving the presumption or the courts will grant a waiver, and the juvenile will be transferred to a criminal court. In today’s nursing, nurses are valued and needed for their reasoning as well as intellectual skills. The changes in nursing require the desire to be more responsible and contributory to the wellbeing of those that needed care. These changes led to more complex ethical dilemmas that nurses’ encounter. This paper aims to provide a reflection on the Ethical Dilemmas presented on the Ethics Game Simulation, the decision-making steps taken to address the ethical issues, how the ethical concepts influenced the decisions made, and the application of the ethical concepts to a medical-surgical unit. The Case of the Troubled Teen This case illustrates Rachel Banks a 16 year-old teenager who got pregnant out of wedlock and currently on her tenth hour of labor on the OB/GYN unit at Seva Medical Center. She’s accompanied by her parents. Rachel’s parents are instructing the staff nurses to withhold the pain medication as punishment for getting pregnant before getting married. Since Rachel Banks is a minor, legally, the parents can decide for her. The nurses are concerned due to the possible detrimental health effects that the situation can cause to Rachel and her unborn baby, Lily. The nurses also became aware that the parents may not be fully educated on the consequences of their decision. In order to make an ethical decision on this case, I used the Baird Decision Model which provided five frameworks: Step 1: Be attentive, Step 2: Be Intelligent, Step 3: Be Reasonable, Step 4: Be Responsible, and Step 5: Be Reflective (University of Phoenix, 2013). The main issue in this case is how to ensure that Rachel and the baby get appropriate and timely medical care. I reviewed the e-mails and communications gathered in order to get a picture of the situation and see that the best possible solution arise. Upon understanding the main issue of this case, I’ve identified that the primary stakeholders includes; Rachel Banks, her parents, her unborn child, the staff nurse, and the primary nurse because they will be impacted on the decisions made in this situation. After identifying the main issue and the primary stakeholders, using the rights/responsibilities lens I was able to identify that my obligations and duties includes providing the best possible care to Rachel Banks and her unborn child, not to accommodate parents who are harming their child, and also support my staff’s professional improvement. On the results lens, I was able to recognize what would create the greatest good for the greatest number of stakeholders which was to involve the nurses and the parents in assessing need for medication intervention and also provide information for aftercare support and education. I believe that the decision made on this scenario benefits both the patient and her family. By involving the parents in the assessment of Rachel’s medical needs, conflict is alleviated and thus, creates a positive outcome. The Case of the Policies and Politics This case is about Alain Trottier, a patient brought in the emergency room by his domestic partner, Yves. Alain was admitted to the ICU unit and has been unconscious. The day- shift supervisor, Carlotta Baldwin is preventing Yves from seeing the patient and refuses provide information regarding the patient because he is not an actual family member. However, according to the hospital policy, domestic partners are to be treated as married couples for the purposes of access and, most importantly, when it must be determined who can make medical decisions for a patient unable to give their own consent. My duty as the nurse taking care of Alain is to identify the critical issue in this situation which is the equal treatment and access of gay partners at Seva Medical Center as equal to those of straight couples. Upon identifying this as the main issue, it is easier to analyze the problem. Again, the following stakeholders were identified: Alain Trottier (patient), Yves (domestic partner), C arlotta Baldwin, RN (shift supervisor), Amelia Flinch (Director of Nursing), the shareholders of the hospital, and lastly, I the staff nurse taking care of Alain. This scenario has led to the identification of relationship lens. The relationship lens focuses on the community. The main concern of this lens is to provide basic liberties to all people (University of Phoenix, 2013). The three rights represented in this case were: right to participate in decision-making for an unconscious family member, right to have hospital policy regarding participation by family members implemented, and right to be informed that your interpretation of hospital policy is inaccurate. I believe that these rights are the major component of this lens because it focuses on the patient, family, and healthcare providers. Upon understanding the basic rights related to this situation, the following actions such as educating all employees with hospital policies, establishing a taskforce to make sure that the policies are put into practice and conducting yearly audits to make sure that the policies are implemented. These actions will ensure that the patient will benefit greatly on the policies placed on the facility. Lastly, the reputation lens discusses the virtues important for leadership; core competencies such as managing diversity, problem-solving, self-knowledge, decision quality and fairness. These values are important because of the overall positive effect that it can bring to the patient and the facility. My final decision in this case is to note on Alains chart that Yves is to be given access and treated as family. Speak to Carlotta about my decision and let my supervisor know. I believe that this decision has no risk. This decision has demonstrated that I am fully knowledgeable on the hospital policies and also implementing what I know for the benefit of my patient. By assuring equal access will likely improve the hospital’s status in the community. Lastly, by informing Carlotta Baldwin and the supervisor know of the decision can be a message that further education is needed for all employees to be more aware and knowledgeable of the hospital policies. Ethical Dilemma at a Medical-Surgical Unit I’ve been working as a RN at a medical-surgical unit for almost a year now. I still consider myself as a novice nurse and I feel that I haven’t been exposed to a lot of ethical dilemmas. However, I believe that pain management or providing pain relief can be an ethical dilemma for any nurse. The ethical issue is this: can we as nurses undertreat a patient’s pain because we are concerned about the repercussions or because we know that the patient is addicted to the medication. I believe when challenging situations like this arise, I need to be conscious of my own biases and make evidence-based decisions that can provide optimal treatment to the patient. By not being judgmental, I can fully assess what would benefit my patient greatly and include him/her on the treatment plan- giving autonomy. By including the patient I can also decrease the harm because I will have a better understanding of what will work best for my patient, and lastly, by hindering my biases I will be able to treat my patient’s pain in a non-discriminating way possible. As nurses continues to encounter complex ethical dilemmas as the profession and society gears forward, we must still go back on the foundation of nursing in accordance to the mission of Florence Nightingale; nurses are missioners of health dedicated to the advancement of human welfare. As for the modern class struggle, the authors of the Manifesto blame industrialization, the discovery of the New World and other foreign markets, and the amount of capital available to the businessmen and the bourgeoisie as reasons for the abuse of the working class. The working class is described as being nearly impossible to make better; they have only the bare minimum to survive and the growth of capitalism is making the proletarian class even bigger. This is why they are fit to rise up, together, in open revolution to change the current social structure, to overthrow the rule of the bourgeoisie. Because of the drive to make money, Marx felt the ties between men had been reduced to â€Å"naked self-interest† and â€Å"cash payment†. (Marx 11) To Marx families were seen as nothing more than a business relationship. John Updike’s A&P and James Joyce’s Araby were born out of close contexts. In fact, both writers are being tagged with a similar designation. He was late in going to the bazaar – or the araby – as he had to wait for his uncle from whom the money he needs will come from.Upon reaching the bazaar, he saw that most of the stalls were already closed and he can no longer fulfill his promise of buying something for the apple of his eye. In the end, he was utterly frustrated and he seemed inert as that feeling gobbled his whole self.Having these two texts at hand, we can find a common theme that is both incorporated in both of them. We can see in these stories how the characters were carried away and frustrated by their circumstances. The concept of the circumstantial forces impinging themselves on human beings and molding the form of their lives is visible in both Updike’s A&P and Joyce’s Araby.The only difference between the two stories in terms of that theme is the way the characters have responded to that force of circumstances.In A&P the entrance of the â€Å"scandalously dressed† ladies created a commotion inside the A&P – a convenience store that is open to the public. The commotion was caused by the fact that the ladies were inappropriately dressed. The store was located on the town – right at the very heart of the city. Evidently, the store was located in a public place.The ladies were wearing clothes as if they are by themselves only and not exposed to many people. One wears a plaid two-piece in green while another wears an off-shoulder bathing suit. The incompatibility of these two elements signals the emergence of the idea that the ladies were swerving from the norm and a necessary action must be done to check what they were doing.This action was made by the manager of the store, Lengel. Wit h all grit and strictness, he accosted the ladies and gave them some serious verbal beating. He established his authority to scold the girls and show to them his disapproval of their deportment and his implication that they leave the store: â€Å"Girls, this isn’t the beach.† (Hart 134).Queenie, the head of the ladies tried to argue for their case against the overture made by the manager but she failed. By having the very pleasant picture of the burger and indeed the various vegetables used, makes the burger seem fresher and generally healthier.It is not just the burgers that McDonald’s have applied this method to, there original red and yellow French fries boxes will now have a full colour of a peeled potato so as to try and emphasise the use of real potatoes in the fries and take the consumers attention away from the high levels of fat and salt that are used. Therefore if we are now in an age where most people are striving to have those kinds of bodies, but they can only get them by being nd eating healthy then fast food chains are surely going to struggle? However McDonald’s have simply changed their style of advertising and branding to help over come this problem. McDonald’s now have a host of celebrity spokespersons ranging from Michael Jordan, arguably the greatest sportsman in the world in the 90’s, the epitome of a healthy person, he and Larry Bird starred in a commercial for McDonald’s in the 90’s. More recently they had an advertising campaign fronted by Justin Timberlake, a pop star who is regarded as very attractive and again a very healthy person.So it is clear to see that the emergence of healthy living has certainly affected how McDonald†™s brands itself. However, it could once again be argued that the emergence of healthy living has not really affected the branding of fast food chains because other hugely successful fast food companies such as KFC (Kentucky Fried Chicken) and Burger King have not used healthy celebrities or sportsmen to brand their products. In fact KFC still have their original mascot of Colonel Sanders, a quite chubby older man, which would not be hugely associated with being the picture of health, say compared to someone like Michael Jordan or Justin Timberlake.

This is not the case for many fledgling writers. In fact, Ive talked to quite a few who have so much fear of being rejected they wont submit their material. While thats one way to avoid rejection, it will stop you from building a writing career. But what if you could turn the process of rejection to your favor? When I decided to write for magazines, I created a writing game. I call it the Big R Game. The rules are simple; in fact, theres only one, and its summarized in the object of the game: Collect as many rejections as you can, as fast as you can, while writing as well as you can. I set my target for 100. This might sound crazy. Why would anyone set a goal to collect a hundred rejection letters? Arent rejection letters to be avoided? These are the two most important activities a writer needs to do if he wants to succeed at the larger game of being a published and profitable writer. Playing the Big R Game also took the edge off of receiving rejection letters. Each time one arrived in the mail, I was winning the game, not only the Big R Game but also the much larger game of becoming a successful writer. Each rejection carried me one step closer to learning my craft. If you have a problem with rejection, try a game or two of the Big R. You may find it lifting your spirit and dissolving the resistance youve added to writing. The other big benefit of the game is that if you set out to collect 100 rejections, you’ll surprisingly receive a fair amount of acceptances. Since playing the Big R Game, Ive published over 350 magazine articles in such publications as Unity Magazine, AARP (then Modern Maturity), Body and Soul (then New Age Journal), Yoga Journal, and Better Homes and Gardens, to mention just a few.
